Law Minister is legally correct in disagreeing with Verma Panel on disqualification

One of the recommendations of report of the Justice J.S Verma committee constituted following the brutal gang rape of a Delhi girl is fraught with pitfalls. The recommendation calls for disqualification of a legislator facing rape charges. Recently a district police-chief of Bihar has claimed that 90% of rape cases lodged with the police are false. My perception is that a majority of FIRs in general registered are false. The Verma panel has also recommended amendment in the Representation of the People Act for this purpose. 

The Law Minister is legally-constitutionally correct to show his unwillingness to amend the Act on this count in the face of falsity of cases and low conviction rate, on the premise that one should not be held guilty unless convicted. 

Governments of the day control police and prosecution and may misuse it as a tool of political vendetta. Merely to disqualify a legislator on the basis of charges framed against him by a Court is flawed. We all know how Courts in practice are mechanical not only in taking cognizance but also in framing charges in such cases. The lower courts are very wary on this count and are inclined to play safe by continuing the trial.

There are cases when politicians and other influential people have actually committed such heinous crimes and the public also know that. The remedy is that political parties must not give them tickets. The voters have also a duty not to vote for such criminals.

Unless police reforms are implemented, policing & investigation segregated, prosecution is made independent and above all corruption & lethargy in judiciary is reduced if not eliminated; we will not be able to purge such criminality from politics and other areas of societal activity.

"हिन्दू आतंकवाद" की ट्रेनिंग कैंप भारत में --शिंदे

भारत के गृह-मंत्री शिंदे ने राष्ट्रीय स्वयं सेवक संघ तथा भारतीय जनता पार्टी पर आरोप लगाया है कि ये दोनों देश में हिन्दू आतंकवाद की ट्रेनिंग कैंप चला रहे हैं। देश के महत्व पूर्ण पद पर आसीन यह व्यक्ति देश की सुरक्षा के लिए जिम्मेदार है। यदि शिंदे के मुताबिक दोनों आतंकवादी संगठन हैं तो शिंदे एक गृह मंत्री के रूप में एक अयोग्य एवं अक्षम गृह मंत्री हैं क्योंकि आजतक वे इन दोनों के  विरुद्ध न तो कोई कार्रवाई कर सके  और न ही कोई जांच। देश आज शिंदे से यह प्रश्न पूछता है कि राष्ट्रहित से जुड़े ऐसे गंभीर मुद्दे पर यह बयान क्या पाकिस्तानी कर्त्ताओं  के प्रभाव में दिया गया ? क्या यह देश को आतंकवाद के विरूद्ध लड़ाई में भटकाने और कमज़ोर करने का प्रयास नहीं  है ? एक गृह मंत्री के तौर पर उन्होंने भारत में  ऐसे कितने आतंकवादी प्रशिक्षण केन्द्रों को ध्वस्त किया ?

हर भारतीय जानता है कि  पाक आतंकी हमारा कितना भी खून बहायें  हमारे राजनीतिक नेतृत्व में इतना दम नहीं कि वे पाक अधिकृत कश्मीर में पाकिस्तानी फौज की देख रेख में चल रहे आतंकवाद के ट्रेनिंग कैम्पों को ध्वस्त कर सकें।

 इस सरकार को, देशवासियों  को यह भी जवाब देना होगा कि इस "आतंकवादी" पार्टी भाजपा से संसद में नुक्लेअर बिल तथा आरक्षण में प्रोन्नति विधेयक को पास करIने में क्यों मदद ली?

अगर  शिंदे की उपरोक्त बातें बेबुनियाद  हैं तो देश को सांप्रदायिक रूप से बांटने का यह प्रयास  निस्संदेह एक सुविचारित राजनितिक योजना है जो राष्ट्रविरोधी है और राष्ट्रपति को ऐसे मंत्री को बर्खास्त करना चाहिए।
 

Teach a ferocious lesson to Pakistan forthwith

Now we have become accustomed to witness barbarism of a rogue state Pakistan repeatedly with a sense of eerie helplessness despite having very brave and highly professional defense forces. If jackals rule the lions the latter will definitely lose their virility, virulence, ferocity and fierceness. 

On December 2, 2012 I wrote a blog in Hindi entitled पाकिस्तान के कराची में एक बिल्डर के द्वारा एक प्राचीन हिन्दू मंदिर ध्वस्त   in which I even had the premonition of the macabre brutality unleashed by Pakistan on the 7^th of this month on our innocent but brave soldiers standing sentinel in sub-zero conditions on the treacherously inhospitable terrains only to give us coziness and assurance of security due to which corrupt political and bureaucratic formations loot our country without disturbance.

When India was shocked, furious, anguished and indignant on the beheading and mutilation of our young Jawans, a Minister also a BCCI member was advocating for a Cricket Test Series with Pakistan. Have we become so heartless and shameless?

We must emulate Israel a tiny nation besieged from all sides by inimical countries the people of which are not only patriotic but have a strong urge to defend unity, integrity & sovereignty of their country ably guided by equally dedicated and resolute political leadership.

My countrymen please expose the peaceniks who are hired to enact Aman ki Asha histrionic.

If we do not pay back Pakistan in the same coin then be ready for more and more bloodshed and mayhem. The traitors inside will have the last laugh.

In our corrupt system an honest individual can not live without being harassed

An ex-army chief known for his integrity, courage and dedicated professionalism has been stripped of security. His fault is that he went ruthless to stamp out corruption in purchase of arms & arsenals and the army-land deals. The two very lucrative businesses which politicians, bureaucrats, generals and the corporate envy one another to carry out even at the cost of life and dignity of the honest who cross their path.  Perhaps this was the reason controversies regarding the date of birth and army movement in Delhi were orchestrated to cut the General to size. Since the time of Nehru from defence jeep scandal to Bofors and further; involving myriad of political parties that came to enjoy power at the centre, the defence-mafia have been calling shots in every part of governance.

The government provides z-category security on tax-payers’ money to political scamesters, goons and criminals but a general with redoubtable record of service to the country and privy to profoundly important defense secrecy is not considered to be protected.

Today I find news papers roaring about efforts to install eavesdropping device in the house of the General. In our corrupt system an honest individual can not live without being harassed and if he tries to act whistle-blower then he should be ready for greater risks.
